What are foreclosure surplus funds?
They are generally funds that may remain after a foreclosure sale and payment of authorized debts, liens, fees, and expenses. The specific definition and distribution process depend on the jurisdiction and sale.
Who may be eligible to claim funds?
Potential claimants may include former property owners, heirs, estates, lienholders, judgment creditors, or other parties with a legally recognized interest. Eligibility and priority depend on the facts and applicable law.
Are there any upfront recovery fees?
No. US Property Recovery does not charge an upfront recovery fee. If you retain us under a written agreement, a recovery fee is owed only if funds are successfully recovered for you, subject to the agreement and applicable law.
What happens if no funds are recovered?
You owe us no recovery fee if we do not successfully recover funds for you.
Are you lawyers?
No. US Property Recovery is not a law firm and does not provide legal advice, legal opinions, court representation, or an attorney-client relationship.
Can I claim the funds myself?
Possibly. Some funds holders provide forms or procedures that allow eligible claimants to apply directly. Hiring a recovery service is not always required.
Do I need every document before I contact you?
No. Start with the property address, former owner, approximate date, and any notice or case information you have.
What if the former owner has died?
A claim may still be possible, but heirship, estate, probate, succession, or representative documents may be required. Legal assistance may also be necessary.
How long does recovery take?
Timing varies widely. The jurisdiction, funds holder, documentation, competing claims, court schedule, liens, and complexity can all affect the timeline. We do not promise a specific completion date.
Will you need my Social Security number or banking information?
Do not send highly sensitive information through the first public inquiry form. Additional identity or tax information may later be required by a funds holder or payment process, but the need and secure method should be explained before collection.
Is recovery guaranteed?
No. We do not guarantee that funds exist, that you are legally entitled to them, that a claim will be approved, how much will be paid, or how long the process will take.
Are you affiliated with a court or government agency?
No. US Property Recovery is a private business and is not a court, sheriff, clerk, trustee, county, parish, state agency, or federal agency.
